22AG Madeira Rent a Car, is a brand of the Portuguese Company “Arraial Colorido, Lda” headquarters at Rua do Curaçau, Nº. 10, 9000-093, Funchal, Madeira, Portugal.

 

TERRITORYALITE

The rental is valid throughout Madeira Island.

 

RENTAL PERIOD

The minimum rental period is 24 hours. The maximum rental period is 31 days. The extension of the rental period requires the signature of a new rental contract.

 

COMPLAINT BOOK

22AGMadeira has a complain book available to customers in physical form at its office and digitally on the website www.22AG Madeira.com.

 

GENERAL CONDITIONS

  1. Age and category of driving licence

It is mandatory to present a valid Citizen Card, Identity Card, Driver’s License, and/or passport, as well as a tax number. The driver must be at least 18 years of age and have a valid driving license for at least one year (12 months) and adequate experience on a motorcycle of a similar size and power to the one proposed to rent. . It is the customer’s sole responsibility to ensure that the driving licence they have is valid for the vehicle they wish to rent. An information table on the categories of driving licences in Portugal is available at the service desk. An additional fee will be charged for the additional driver. There is no maximum age.

  1. Documents

The customer will be given the original of the contract, a single car document, proof of the motor vehicle liability insurance policy and an inspection form, when applicable. If the Vehicle is not returned with the documents delivered at the time of the start of the rental, the cost of €120 per missing document will be charged, as well as an administrative fee for the processing of the same, in the amount of €35.

  1. Reservations

22AGMadeira will always make every possible effort to provide the vehicle booked for the rental period. If, for reasons of force majeure, it is not possible to supply the reserved model, an equivalent may replace the reserved model. If the replacement is made by a lower fare model than the one initially reserved by the customer, 22AGMadeira will refund the amount of the difference in fares. In the event that the rate of the replacement vehicle is higher than the vehicle initially reserved by the customer, this difference will be borne by 22AGMadeira.

  1. Payment Terms

The cost of the rental can be paid at the time of booking or at the time of delivery of the vehicle. Valid credit cards are accepted: Visa

  1. Changes and Cancellations

Changes:

You can modify or change your booking, free of charge up to 48 days before the rental starts. New rental prices may apply when modifying the booking. The same communication channels that were used when booking the vehicle must be used.

Cancellations:

The refund due to the cancellation of a reservation will be made as follows: 100% up to 120 hours before the start of the rental, 50% up to 48 hours before the start of the rental and 25% up to less than 48 hours. Returns and cancellations do not include fees.

  1. Return Policy

Refunds of payments made are automatically issued when the request is made to cancel the reservation. Whenever possible, the return must be made by the same means of payment, but if this is not possible, the user must present proof of payment and ownership of an account or card, so that the return can be made by Bank Transfer.

22AGMadeira undertakes to return all amounts received (except bank fees) within a maximum period of 5 working days.

No refunds will be made if the rental ends early if the customer does not show up to pick up the car or if the reservation is cancelled less than 24 hours in advance.

  1. Regarding Rental

Our prices include:

  • Unlimited mileage
  • Current local taxes (VAT);
  • Compulsory insurance with deductible or insurance without deductible;
  • Replacement vehicle in case of accident;
  • Airport service fee;
  • Possibility of payment at destination;
  • Emergency contact service.

Our prices do not include:

  • Fuel;
  • Optional covers;
  • Additional extras to be applied to the total number of rental days.
  • Damage / Loss / Theft of keys, fuel filler cap, luggage compartment or any other moving or fixed component of the vehicle.
  • Engine damage due to negligence.
  • Theft of the vehicle with the keys in the ignition.
  • Loss/Damage/Theft of personal belongings.
  1. Pick-up and drop-off of the vehicle

The delivery and return of the vehicle will take place at the 22AGMadeira premises or at a location to be arranged. The vehicle will be identified by printed stickers applied to the rear and sides of the vehicle. If the customer wishes to extend the rental period, they must inform 22AGMadeira at least 24 hours in advance. Depending on the availability of the fleet, 22AGMadeira may or may not authorize the extension of the rental period.

The premature return of the vehicle by the customer will not incur a refund of the rental amount paid. The delay in the return of the vehicle, which exceeds 30 minutes, without the customer having informed 22AG Madeira, implies the payment of an administrative fee in the amount of €50 to be debited at the time of return of the vehicle.

If the extension of the rental period is not requested and the vehicle is not returned at the address, date and time stipulated in the rental agreement, it will be considered illegal use of the vehicle and this fact will be reported to the Portuguese authorities. The vehicle to be rented will be inspected upon delivery and collection by 22AG Madeira and the customer, thus verifying the condition of the vehicle to be rented.

  1. Deductibles and Deductible Reductions

A credit or debit card deposit may be required, the amount of which varies depending on the group of the vehicle booked, in order to guarantee costs inherent to possible damages caused or suffered in the rented vehicle. After verifying that there are no damages or costs inherent to the rental agreement, the deposit of the excess will be refunded through the same means used for the payment of the same.

  1. Complementary Extras

The vehicles may be equipped with optional extras that will be included in the final price, as long as they are selected at the time of booking.

  1. Insurance

The following insurance coverages are included in the rental rate:

  • Mandatory civil liability
  • Own damage and theft with a deductible amount specified in the rental agreement.
  • Roadside assistance.

The deductible for fall or collision damage and theft is defined by the security deposit (blocked on a credit or debit card) held by 22AGMadeira and specified in the rental agreement, the amount of which varies according to the rented model.

With regard to damage or theft of the motorcycle, the own damage deductible is always the maximum responsibility of the customer

Under no circumstances does the own damage coverage cover the damage or loss of rented accessories such as GPS, helmets, jackets, etc.

The insurance policy will automatically be deemed to be void if:

  • The client leaves the scene of the accident in which he or she is involved.
  • The customer does not immediately report the disappearance of the vehicle to the authorities and 22AGMadeira.
  • The rented vehicle is premeditated by the customer or someone for whom the customer is responsible
  • The vehicle is involved in an accident and the customer does not inform 22AGMore as soon as possible
  • The vehicle is driven by the customer and the customer is under the influence of alcohol, drugs or other narcotic substances
  • The vehicle is driven in areas not authorized by 22AGMadeira such as competition circuits, off national roads or outside the national territory
  • If the customer does not meet the requirements stipulated in point 12 which describe the customer’s responsibilities
  1. Customer Responsibilities.

The customer is responsible for ensuring that they have a valid driver’s license to drive the vehicle they propose to rent. Driver’s license and ID card or passport have to be presented by the customer.

During the rental period, the customer is responsible for all fines and violations of the highway code or other violations of the law.

22AGMadeira is responsible for informing the identity of the customer or giving other information to the Portuguese authorities whenever requested.

It is the customer’s responsibility to ensure that the rental vehicle:

  • Will be used according to the manufacturer’s recommendations
  • It will be used in full compliance with the highway code of the country in which it is driven
  • Will Not be used negligently
  • Will not be used in competitions
  • Will not be used off-road or conventional roads
  • Will not be used for illegal reasons
  • Will not be used with weight greater than its authorized capacity
  • You will not be driven by someone who is not listed on the rental agreement
  • Will not be used if its mechanical condition is deemed unsafe
  • Will not be used under the influence of alcohol, drugs or other narcotic substances
  • Will not be used if the client’s physical condition is weakened by illness or tiredness

Failure to comply with any of the previous paragraphs involves immediate cancellation of the insurance making the customer fully responsible for the total value of the motorcycle and accessories.

  1. Fuel Policy

The vehicle must be returned with the same amount of fuel with which it was delivered. If it is not returned with the same amount, the missing fuel will be charged. The calculation of this amount will be €10 for each missing storage room, depending on the rented model. The missing amount will be communicated by 22AG Madeira to the customer at the time of return of the Vehicle.

An administrative fee of €20.00 will be charged for replenishment. 22AG Madeira is not responsible for damages caused due to the mistake in the type of fuel that is supplied. It will always be the driver’s responsibility to pay the amounts of the damage caused.

  1. Location Devices

The customer is aware that the vehicle may be equipped with a geo-location device that can be used in the event of non-performance of the contract, theft or crossing of borders.

  1. Cleaning Fee

Cleaning fee, to be charged between €20 and €50 if the returned vehicle is dirtier than its contractual use, particularly if its interior is dirty, muddy, sandy, smelly or tobacco burns.

  1. Accidents or Mechanical Breakdowns

Accidents:

In the event of an accident, contact 22AG Madeira, so that they can advise the customer throughout the process. If justified, it is recommended that the customer call Roadside Assistance and/or the Police authorities (112), call an ambulance in case there are injuries, obtain from the other drivers involved: Name, address and telephone number, Driving licence number, date and place of issue, make, model and registration of other vehicles, Insurance policy

Malfunctions:

In the event of a mechanical breakdown, the customer should contact 22AGMadeira informing its exact location and detailing the type of breakdown as best as possible. If it is necessary and possible to repair it, the customer must obtain permission from 22AGMore to do so. If the repair is not possible, the 22AGMadeira will try by all means to replace the damaged vehicle in the shortest possible time.

22AGMadeira will refund the customer for the time the vehicle is immobilized, if for any reason the replacement of the vehicle is not possible, 22AGMadeira will refund the customer for all unused days.

Refunds or replacements of the vehicle are excluded if they are caused by accidents or mechanical breakdown caused by a fall or misuse of the vehicle.

  1. Roadside Assistance

In case of breakdown or accident, 22AGMadeira provides a 24-hour Roadside Assistance service: ensuring the transport of the vehicle and its occupants to the nearest 22AG Madeira. It also ensures the same or similar replacement vehicle within a maximum period of 24 hours.

  1. Extra Services

The prices of the extra services are displayed on the booking page.

  1. Damage Caused by Negligence

As a result of the use of the wrong fuel, the customer will have to pay the following costs: Running out of fuel: €100;

Wrong fuel, without causing damage to mechanics or engine: €180 to €500, plus missing fuel;

Wrong fuel with damage to the mechanics or engine will always be the subject of a quote in a specialized workshop.

Battery out of charge because of negligence: €100;

Loss of Keys € 100 to €250.

Punctures and/or damage that only destroy the tyre will be charged a fee of €125 to €400 to be charged from the deposit,

Damage, scratches or destruction of rims will be charged a fee of €130 to €600, to be charged from the deposit,

While the vehicle is stopped due to any type of repair, a fee of €18 per day will be charged, up to a maximum of €270 (15 days)

For all damages caused by negligence, an administrative fee of €50 will be charged for the treatment of the same.

  1. Traffic Fines or Violations

Payment of traffic fines or violations during the rental period is the responsibility of the renter. An administrative fee of €50 per infraction will be charged for the treatment of fines. These administration fees are payable in addition to the amount of the fines, and the client is fully responsible for the full payment of the fines. All legal means will be used in the event of refusal or litigation in the collection of fines and infractions.

  1. Coverage & Liability

The rental rates include the coverage of the Compulsory Automobile Insurance and Civil Liability for damages and losses against third parties derived from the use and circulation of the vehicle. The 22AGMay offers two additional options: Medium and Premium. (Coverage for the driver of the vehicle and all occupants), which can be added at the time of booking.

22AGMadeira is not responsible for theft, robbery or deterioration of the customer’s objects that are inside the vehicle. In case of theft, total or partial theft of the vehicle, the customer undertakes to inform 22AGMadeira by phone, within a maximum of 24 hours, as well as to report it to the Police authorities.   1. Data Protection

22AGMadeira only collects and processes personal data directly provided by the client in order to comply with and manage pre-contractual and contractual obligations; marketing; comply with legal obligations; manage user registrations; rights and ownership; accounting, tax and administrative management and will be used solely and exclusively for the purposes identified.

  1. Means of Complaint / Dispute Resolution

In the event of a dispute, 22AG Madeira has at its disposal a Customer Support service through general @22AG Madeira.com

The client or 22AG Madeira may submit the resolution of the dispute to the competent Courts, which may be the Courts of his/her residence or those of the country of rental.

22AG Madeira reserves the right to change these general conditions without prior notice.

22AG Madeira, hereby rents to the subscribed client, the vehicle described in the terms and conditions of this document, by virtue of which the client acknowledges and agrees.
